Phyllis promised Nicholas that no one would find out about them. Right after, Sharon barged in, demanding to talk to them about something which was on her mind. They were surprised when Sharon apologized for things being so tense around the office. Phyllis quickly left when Sharon began planning a romantic evening with Nick. "What was that about?" asked Sharon. "It's like she doesn't want to be around me." Perhaps. Or maybe she just isn't comfortable watching you make goo-goo eyes at your hubby in front of her, Shar — for several reasons. Sharon then suggested that she and Nick order in from "the French place on Union." Is it a fast-food French place? Do they serve Escargot McNuggets and Quarter Pounder Paté? Later, Sharon approached Phyll alone. "What do you want?" Phyllis nervously asked. "I wanted to talk to you about you, me and my husband," Sharon explained. Oops, it was another false alarm. Sharon was just apologizing — again — for having put Phyllis in the middle of a business-related argument between Sharon and Nick. Phyllis buttered her up by stating that Sharon would make a great spokesperson for the spas. After, Phyllis slumped down with relief and exhaustion. "Oh my God," she whispered to herself. "It just killed me now." She then thought of her last sexcapade with Nick ... who soon stopped by to see her. Phyllis filled him in on her convo with Sharon. The duo began getting it on again (talking about how "hungry" they are in the process. Perhaps they should call that French place?). Sharon then ran back upstairs to get her keys, which she'd forgotten. D'oh!
Ashley believed that Gloria would be "a little happy" if Ash went to prison, which is why Glo's been helping her keep John's culpability in Tom's murder case under wraps. Gloria denied this; she, Ashley and Jack tried to come up with another plan to help John. "I will do anything to protect my husband!" shrieked Glo. After, the gang got a call that John was with the DA. Jack hoped they'd gotten through to John.
Too late. At the hospital, John told the DA, Will, that he recalls killing Tom. Later, the group arrived just as John was asking Will why he wasn't going to arrest him. Gloria began screaming at Will to get out and leave her husband around. John insisted that Will stay so they could finish his conversation. Will told them that John had called him.
At the GCAC, Mackenzie and J.T. hung out. Mac asked where he'd been before, but he still didn't tell her he'd been with Colleen, and came up with a lame excuse instead. Soon, Colleen and Daniel arrived. Colleen apologized to Mac for lashing out at her earlier. She then sweetly told Mac how she's feeling better since she'd had a talk with J.T. Boy, Col is a little, uh, pot-stirrer, isn't she? "Er, um ... argh," grumbled a red-faced J.T. as he tried to squirm his way out of this one. To her credit, Mac just smiled and acted as if everything were okay. It was only after, when they were alone, that Mac let her man have it. "I didn't lie to you," J.T. argued. "Not technically." Yeah, and Clinton didn't inhale. Nice going, Jeffrey Todd. Daniel, meanwhile, called Colleen on her manipulation. Col insisted that she wasn't trying to do anything.... Mac was concerned about the state of her and J.T.'s relationship. She may also want to take into account that all she and J.T. ever do in their relationship ... is talk about the state of it. Yikes.
Victor listened, enraptured, as Nikki practiced the piano. And, wow — what was up with that elaborate candelabra hanging behind the piano? Is Nikki now Liberace? When she finished, Victor admitted that he has some regrets over handing the company over to Nick and Victoria. Nikki couldn't understand why; he explained that he basically feels useless without a job and envies Nikki for having the spas to work on. Nikki invited her hubby to work on the project with them. He eagerly accepted. Nikki was excited that they'd be going into business together ... and Vic immediately began taking charge, telling Nikki what they should do.

Jack confided in Phyllis about John's hospitalization and his family's problems. Phyllis reasoned that his being under stress is yet another reason why he shouldn't go after her and Nikki and their spa project. "Your concern is touching," he seethed, denying that his actions had anything to do with Victor. They were soon interrupted by a fuzzy-wuzzy Gloria (wearing a coat that made her look like a grizzly bear), who asked for John. Phyllis left. Jack attempted to stall Gloria, but felt bad when she revealed that she'd been with Kevin picking up Tom's ashes. Jack lied that John just needed to get out of the house, but Glo didn't believe him. Jack finally told her that John's in the hospital. Glo believed that Jack wants John to confess in order to protect Ashley, but Jack told her she was being ridiculous. Glo blamed herself for the family's problems.... At the hospital, John called the D.A., but lied to Ashley that it had been a business call. Later, John prepared to give information on the night Tom was killed. "It wasn't Ashley, it was me!" he shouted. "I killed Tom Fisher."
Nikki noted that Sharon and Nick seem to be drifting apart. She tried to give Sharon some marital advice, but Sharon told her MIL to MHOB. Nikki warned her not to be careless and lose Nick's love. Sharon left when Phyllis stopped by to discuss business with Nikki. Nick then paid a visit, telling his mom that he needed to see Phyllis to deal with the "Web site." Oh, is that what they're calling it these days? "That was close," Phyll declared after Nikki left. "Every moment with you is close," he replied. The duo then came up with some "ground rules" so they wouldn't get caught. Later, Victoria and Nikki met for lunch, where Nikki complained to her daughter about Nick and Sharon. Victoria urged her to let them work things out.
At the GCAC, Lauren and Michael discussed Tom's murder case. Kevin interrupted them ... to bring them a big, ol' box of Tom's "cremains." Now, how sanitary is it that he brought a big, 'ol box of what was once human remains to an eatery?! Anyway, Kevin found it difficult to believe that his father — and all the pain he'd caused Kevin — had been reduced to a box. "What are you going to do with him? Him?" Michael stuttered, wondering what the correct pronoun is to use in such a case. Kevin offered "Tom" to Lauren and Mike (hope this wasn't his idea of a wedding present), but Michael refused: "He's not welcome in our house no matter how small a box you put him in." Kevin then came up with a better idea — stuffing the ashes into a locked closet. Paging R. Kelly! Later, Michael promised not to keep secrets from Lauren. Lauren noted that she knows he and Ashley had been involved in something.
J.T. admitted to Colleen that he's not sure he can trust Kevin. Colleen was sure that Kevin would eventually snap and she'd be proven right for thinking him the enemy. Later, Mackenzie comforted Kevin. He hoped J.T. knew how lucky he is. Mac wondered if he and J.T. could be friends, but Kevin wasn't so sure. Soon, J.T. met up with Mac, but didn't reveal that he'd been with Colleen.

John was rushed to the hospital after Ashley found him collapsed in the hallway. The doctor reported that he hadn't actually had a heart attack — it was just a reaction to stress. Ashley told Michael that she's not letting John confess about shooting Tom and face charges because she doesn't believe he's strong enough to take it. Jack encouraged John to believe that Michael could help Ashley in a trial, and urged his dad not to do anything rash. Later, John called the DA from his hospital room.
Phyllis and Nikki couldn't believe that Jack filed an injunction against them in regards to the spa project. Nikki reasoned that he had no right to do it since he'd turned down their idea. Victor explained that Jack could indeed do this if a clause had been in Phyllis's contract with Jabot. Phyll was furious that Jack would do this to her and declared "war." Only in this version of War Of The Roses said roses would be the ones floating in the hot tubs at the spa. Mmmmm.... Anyway, Vic offered to help them with this one, but an impatient Phyll stormed out to see Jack. Victor suggested that Nikki begin a new project with a different person — someone with less baggage, for starters. Meanwhile, Phyllis reamed out Jack. He didn't want to discuss it, but she insisted. "How badly have you already screwed me over?" she wondered.
Sharon stopped by to see Brad at the office. He filled in Sharon on his and Victoria's disagreement over whether Abby should return to school. Sharon, of course, agreed with him. Brad was glad that Victoria and Abby are starting to warm up to each other. Meanwhile, Victoria stared into space and flashed back to the entire conversation that (to viewers) they'd just had yesterday and (in their world), they'd just had a few hours before. Once Vicki came back to Earth, she admired Abby's drawing for her book report. When Abby stated that she missed her friends and wanted to show them her drawing, Victoria suggested she go to the school for a little while. Uh-oh... Later, Brad was furious when he learned that Victoria had taken his daughter to school ... until Abby reported that she'd had fun. Victoria couldn't help gloating a little when Abby asked if she could go back again.
Kevin told J.T. about his and Colleen's argument at Daniel's party. J.T. revealed that he's only tolerating Kevin to keep Mackenzie happy. Kev was disappointed because he thought he and J.T. were becoming friends. J.T. explained that he's not going to trash Kevin, but he's not going to stick up for him either.... Colleen promised Daniel that there would be no more "scenes" between her and Kevin, but wasn't sure Kevin really could change. She reminded him how Kevin had hurt Lily, but Daniel wasn't convinced, stating that Kevin's been through therapy.

Nicholas was concerned about Phyllis having an office at Newman. Phyllis won him over by encouraging him to think of this as an "opportunity" for them to spend plenty of quality time together. Nick wasn't sure he could control himself.
Meanwhile, Victor asked Sharon why Nick wasn't happy with Phyllis using Newman's office space. Later, Sharon asked Nick why he's against Nikki and Phyllis working there. Sharon thought he should be glad to have his family nearby, but Nick argued that Phyllis isn't family. Sharon explained that it could be a good opportunity for cross-promotion of the cosmetic line, and suggested that she be the spokesmodel. Nick didn't think this was a good idea.
John promised Abby that he wouldn't let Ashley go to jail. Ashley didn't want him to give her false hope, but he replied that he knew she wasn't guilty of shooting Tom. After, Abby asked Brad if what John said was true. Brad replied that John was going to do everything he could. Victoria thought Abby should return to school, but Brad disagreed. Victoria explained that they can't keep coddling Abby, and that the little girl needs to focus on something other than Ashley's impending trial. "You've never been a parent," Brad huffed. "I am a child of divorce," Victoria stated.
At the GCAC, Jack cornered Michael, demanding to know how Mike intended to keep Ashley out of prison. Michael filled him in on John remembering that he killed Tom. John, meanwhile, told this to Ashley, and couldn't understand why she's taking the blame. He explained that it had been in self-defense. He refused to let her take the fall; she refused to let him confess. Later, Jack called and told Ashley not to let John leave the house. Ashley agreed, but then found John collapsed in the hallway.
Devon and Sierra paid Daniel a surprise visit. Mackenzie then stopped by with breakfast, soon followed by Colleen. Tensions arose when Colleen asked Mac about J.T.'s whereabouts. Daniel was puzzled as to why everyone was there; Sierra revealed that Phyllis had suggested they surprise him as a way to cheer him up about Lily. Daniel allowed them to stay, provided they had a particular muffin for him. Things became more awkward when Kevin arrived. "You and Kevin have succeeded in brainwashing the whole town," said Colleen. An argument ensued when Mac retorted that it's Daniel's house and Kevin can stay if Daniel wants. Colleen refused to buy that and stated that if Kevin's really changed, he'll leave the room whenever he sees her. Great strategy, Colleen, considering you and the other kids spend half your lives in what's now Kevin's coffeehouse. Kevin wouldn't do this; Mac and the others defended him. Colleen was shocked that Devon would stand up for him when Kevin had hurt Lily. She then stuck her foot in it when she revealed that she was going to try to call Lily for Daniel; Devon was furious, realizing that Daniel wasn't really over her. Later, Daniel reamed out his mom for — gasp! — having the nerve to plan a party for him. Colleen then returned and apologized for ruining his breakfast.
Victor informed Phyllis that Jack filed an injunction against her and Nikki so they couldn't get their spa project off the ground.

In the alley, John again asked Michael why Ashley has been arrested for a murder that John believes he committed. John recalled that he was probably going to confess when he had his car accident, and couldn't understand why Gloria and Ashley have been lying to him. Michael revealed that Ash had already confessed. John realized that she was trying to protect him because of his heart problems (Like he's really going to feel better knowing that his daughter took the rap for him.). John was determined to make things right and planned to go to the police. Michael stopped him.
Meanwhile, Gloria urged Jack to keep his mouth shut about John shooting Tom. Jack wasn't so sure they could hide the truth for long, and feared what would happen to Ashley — and Jabot. Glo couldn't believe that Jack cared more for his company, but he reminded her that John and the company were tied together. Jack assured Gloria that he'd never hurt his dad, but wouldn't take orders from her. Later, John came home and asked Gloria to stop treating him like a child. Alone, Glo asked Michael how things were looking for Ashley. Mike responded by stating that everything keeps going wrong and that Tom's probably in Hell laughing at them. In other words, not so good, Glo. Gloria believed that Michael could get the jury to side with Ashley.
At the GCAC, Jill talked on the phone to a reporter, telling the person that Ashley isn't granting interviews. Jill confided in Gina about how difficult Ashley's arrest has been on the family and the company. Jack soon joined her, and they discussed how they could do some damage control on Jabot.
Sharon, home from Denver, planned to surprise Nicholas at the office ... who was just finishing up with Phyllis in a hotel room. Brad didn't know where Nick was. Sharon then asked how Brad is and he admitted that Abby's been having a difficult time dealing with the Ashley situation. Soon, Victoria arrived and informed Sharon that she saw Nick with Phyllis. "What was he doing with Phyllis?" Sharon wondered. Oh, if only you knew! To answer that, Nick and Phyll were busy going at it again. After, a naked Phyll told Nick that she's able to "handle" the affair and that they should just "live in the moment." Sharon then called, making for an extremely awkward moment. Nick promised to meet her at home, but only gave Shar a polite "Me, too," when she stated that she loves him. Phyllis encouraged him to go home to his wife. Brad told Sharon that he's glad things are working out for her and Nick. Later, Victoria whined to Brad that she wishes they were already and that she was jealous of Sharon and Nick (Um, dear, you might want to pick some other role models.). Brad promised they wouldn't have to keep their engagement secret forever.... Nick went home to Sharon.... Jack told Phyllis that he needs her, but she reminded him that there was a good reason their marriage failed the first time around. "Please move on, for your own sake," she said, holding back tears.
At the GCAC, Gina served a mopey Daniel an ice-cream sundae, minus a certain common sundae ingredient (the best part, mind you). Devon soon arrived and Daniel asked him to tell Lily that he was "cool" with the breakup. Devon told him he's doing the right thing (Yeah, like that's really going to make him feel better. Yeesh.).
Dru arrived home from her Denver trip and eagerly greeted Neil. "What's been going on?" she asked, unaware of Yolanda's failed attempt to seduce her hubby. Neil quickly filled her in on Yo's escapades and how she left town. Dru was aghast that Yolanda wanted a piece o' Neil, and worried about how this would affect Devon. Later, Devon lamented that he was stupid for getting his hopes up when it came to his mom. Dru was surprisingly felicitous when it came to defending Yolanda, and urged Devon to be proud of Yo for turning her life around and getting off drugs.
